WE PROTECT AGAINST PRODUCT PIRACY

The Czech Republic has recently adjusted its legislation in the area of combating product piracy to comply with European Union law and broader international efforts to create a global intellectual property standard. National legislation now meets the obligations of membership of the (a) the World Trade Organisation (in particular the TRIPS Agreement); and (b) in the Paris Convention (as amended by the Additional Protocols).

This extensive legislation protects producers as well as consumers against product piracy by helping consumers to distinguish between identical or interchangeable products from each producer and thus enable them to rely on the quality of the product.

Infringement here typically involves the unauthorized use of an intangible good – such as a trademark – that is of such a deplorable nature that its misuse becomes difficult to control. A counterfeit product is wrongfully marked with a trademark, which in most cases constitutes illegal use of a trademark, but also of a utility or industrial design.
